Maawanji’idiwag, LLC owns and operates this website (hereinafter referred to as the (“Service”). Maawanji’idiwag, LLC is a wholly owned and operated economic arm and instrumentality of the Lac Vieux Desert Band of Lake Superior Chippewa Indians (“Tribe”), a federally recognized Indian tribe, created for the benefit of the Tribe and operating pursuant to Tribal law.


The terms “Maawanji’idiwag”, “company”, “we”, “us”, and “our” mean Maawanji’idiwag, LLC. The terms “you” and “your” mean the individual who visits or uses our Service. By using and/or accessing this Service, you are agreeing to comply with and be legally bound by the Maawanji’idiwag Privacy Policy and these Terms of Service. 


Acceptance of Terms

PLEASE READ THESE TERMS OF SERVICE (“TERMS”) CAREFULLY. THESE TERMS ARE A LEGAL AGREEMENT BETWEEN YOU AND MAAWANJI'IDIWAG, AND ALL RELATED AFFILIATES FOR USE OF THE SERVICE, COMMUNICATIONS, UPDATES, INFORMATION, THE SERVERS USED BY THE SERVICE, THE COMPUTER FILES STORED ON SUCH SERVICE, AND ALL RELATED SERVICES, FEATURES, AND CONTENT OFFERED BY US (COLLECTIVELY "AGREEMENT"). BY VIEWING, READING, ACCESSING, OR INTERACTING WITH THE SERVICE AND ANY PAGES THEREOF, OR WITH ANY BANNER, POP-UP, OR ADVERTISING THAT APPEARS ON IT, YOU ARE AGREEING TO ALL THE PROVISIONS OF THIS AGREEMENT AND THE PRIVACY POLICY OF THE COMPANY. We may also store data snippets (“cookies”) on the user or end-users’ equipment, as allowed by acceptance of cookies through your local preferences. When you access or use the Service, you represent that you have read, understood, and agree to be bound by the Terms of this Agreement and to the collection and use of your information as set forth in the Privacy Policy. We require that all visitors to our site adhere to the following Terms. If you do not agree with these Terms, you should immediately cease using the Service. If a user violates any of these Terms, we reserve the right to cancel accounts or bar access without notice.


Modification and Changes to the Terms of Use

We reserve the right, in our sole discretion, to update or modify the Terms at any time without notice to you. Any changes to the Terms will be effective upon posting them on the Service. Unless you have entered into an express written contract with Maawanji’idiwag, LLC to the contrary, visitors, viewers, subscribers, consumers, or customers have no right to use this information in a commercial or public setting; they have no right to broadcast it, copy it, save it, print it, sell it, or publish any portions of the content of the Service.

 

We provide a Service that consumers use to connect with lenders that provide consumer loans. Maawanji’idiwag, LLC is not a lender; we do not make loans or credit decisions. We are not an agent or broker of any lender. We provide a service that aims to connect you to a lender in our network. We are not responsible for and have no control over lenders’ actions or decisions.

 

We do not guarantee that any of the lenders or lead providers to whom we share your information will contact you or agree to provide you a loan. You should be aware that faxing of documents may be required and a credit check may be conducted. When we connect you with a lender, you will be redirected to the lender’s website and you should be able to review the loan terms before accepting the loan agreement.

 

You may use the Service only by agreeing to all applicable Terms, including our Privacy Policy and only in compliance with this agreement and all applicable Tribal, federal, state, or local law, regulation, rule or ordinance that could give rise to any civil or criminal liability.

You are solely responsible for the accuracy of any information you submit. We are not responsible or liable for checking the accuracy of any information you provide. We are not responsible for any decisions or actions taken by you based on your use of the Service.


Use of Information

We reserve the right, and you authorize us, to use and assign all information regarding use of the Service by you and all information provided by you in any manner consistent with our Privacy Policy.


Limited License

Subject to the Terms and conditions of this Agreement, you are hereby granted a non-exclusive, limited, non-transferable, freely revocable license to use the Service in accordance with the Terms of this Agreement. We reserve all rights not expressly granted herein in the Service and associated content. We may terminate this license at any time for any reason or no reason.

 

All rights, title, and interest in and to the Service not expressly granted in this Agreement are reserved by the company. Creative content, the Service, and our software, title, trade name, trademark, service mark, logo, domain name and/or any other identification with notable brand features are protected under applicable copyrights, trademarks, and other proprietary rights of the company. Except as expressly and unambiguously provided herein, we do not grant you any express or implied rights, and all rights in and to the Service and associated content are retained by us.


Minors

This site is not directed at children under 13 years of age or anyone under the age of 18. We do not knowingly collect personal information from anyone under the age of 18. By using this Site, you represent and warrant that you are at least 18 years of age. If we learn we have collected or received personal information from a child under 18 without verification of parental consent, we will delete that information.


Disclaimers of Warranties

THE SERVICE IS PROVIDED "AS IS" AND WITHOUT ANY WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT OR ACCURACY. ADDITIONALLY, WE DO NOT WARRANT THAT THE SITE IS FREE FROM HARMFUL VIRUSES.


WE MAY AMEND OR MODIFY THE SERVICE AND ASSOCIATED CONTENT WITHOUT NOTICE TO YOU OR ANY LIABILITY TO YOU. YOU USE THE SERVICE AT YOUR OWN RISK AND YOU ASSUME TOTAL RESPONSIBILITY FOR YOUR USE OF THE SERVICE AND ANY LINKED SITES.


Limitations of Liabilities

UNDER NO CIRCUMSTANCES WILL THE COMPANY, ITS MEMBERS, AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS, SUCCESSORS OR ASSIGNS BE LIABLE TO YOU FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, COST OF PROCURING SUBSTITUTE SERVICE OR LOST OPPORTUNITY, EVEN IF THE COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, WHETHER IN AN ACTION IN CONTRACT, TORT, STRICT LIABILITY OR OTHERWISE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, ANY LINKED SITE, OR RESULTING FROM A DELAY OR INABILITY TO USE THE SERVICE OR A LINKED SITE. UNLESS OTHERWISE EXPRESSLY SET FORTH IN A SEPARATE WRITTEN AGREEMENT WITH YOU, THE COMPANY SHALL NOT BE LIABLE FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE.


Indemnity

By using the Service, you agree to defend, indemnify, and hold harmless Maawanji’idiwag, LLC, its members, affiliates, directors, officers, employees, agents, contractors, successors and assigns (“Indemnified Parties”) from and against any and all losses, claims, damages, costs and expenses (including but not limited to reasonable legal and accounting fees) that Indemnified Parties may incur arising or resulting from your use of the Service, the content of the Service, or your breach of this Agreement. Indemnified Parties reserve the right to assume or participate, at your expense, in the investigation, settlement and defense of any such action or claim.


Sovereign Entity

This Service is made available to you by Maawanji’idiwag, LLC, a wholly owned and operated economic arm and instrumentality of the Lac Vieux Desert Band of Lake Superior Chippewa Indians (“Tribe”), a federally recognized Indian tribe, created for the benefit of the Tribe and operating pursuant to Tribal law.


Preservation of Sovereign Immunity

It is the express intention of the Tribe and Maawanji’idiwag, LLC, operating as an economic arm-of-the-tribe, to fully preserve, and not waive either in whole or in part, exclusive jurisdiction, sovereign immunity, and any other rights, titles, privileges, and immunities, to which they are entitled. To protect and preserve the rights of the parties, no person may assume a waiver of immunity exists except by express written resolution of the Tribe's Tribal Council specifically authorizing such a waiver as required by Article XIII of the Tribe’s Constitution specifically for the matter in question.


Termination

We may terminate this Agreement at any time, with or without notice, for any reason.

for loans, and does not make any credit decisions. We are not a representative or agent of any lender and have no control over the lenders or lending partners in our network. Maawanji’idiwag, LLC is a wholly owned subsidiary of Tribal Economic Development Holdings, LLC, a wholly owned and operated economic arm and instrumentality of the Lac Vieux Desert Band of Lake Superior Chippewa Indians (“Tribe”), a federally recognized Indian tribe, created for the benefit of the Tribe and operating pursuant to Tribal law.


Use of our Service and submission of a loan request is not submission of a loan application. We do not guarantee that you will be approved for a loan. This Service may not be available to residents of every state. Some lenders or lending partners may obtain consumer reports or conduct credit checks through Equifax, Experian,

TransUnion, or other alternative credit bureaus. Some lenders may require faxing of information. In some instances, you may have to visit a physical store or branch location to complete your loan request process. Please contact your lender directly with questions or issues regarding your loan.

 

Consumer Notice

Shorter-duration loans from third-party lenders are meant to provide temporary relief for financial needs and are not intended as long-term financial solutions. Consumers who have credit problems or who face debt should seek professional debt and credit counseling. Non-payment of credit could result in collections activities. Third-party lenders have their own policies regarding non-payment. We strongly encourage you to review your particular lender’s policy on non-payment including any fees and penalties you may be subject to for non-payment.


Paid by Lenders, Lending Partners, Networks, or Other Marketers

The operator of this Service does not make loan offers; we aim to connect consumers with lenders. Submitting a loan request allows us to connect you to third-party lenders, lending partners, other networks and marketers, and these parties pay us if they offer you a loan or if a lender within their network is able to offer you a loan. If you receive a loan offer, be advised that the lender or lending partner you are paired with may not offer you the best loan terms for your financial situation.

 

Credit Implications

Third-party lenders may conduct credit checks with credit bureaus or obtain consumer reports through alternative providers to determine your eligibility for a loan. By submitting your information to us, you agree to allow us to share your information with lenders, lending partners, and marketing partners in our network and for these parties to verify your information and perform credit checks. You are not obligated to contract with any third-party lender or party within our network.


Availability

Our Service is not available in all states. We reserve the right to change the availability of our Service at any time without notice. If you request a loan in a state where such loans or loan products are prohibited, or where our Service does not have an available lender or lending partner, you will not be connected to a lender or lending partner. Please familiarize yourself with your state’s regulations pertaining to shorter-duration loans. In using our Service, it’s possible that you may be connected with a tribal lender. Please be aware, tribal lenders are subject to tribal law and particular federal laws, which govern its loans and related agreements, but are exempt from abiding by state law. Please fully read and understand the terms of any loan offered by any lender. Do not agree to a shorter-duration loan offer that includes terms you do not agree to, or that you are unable to repay.


Marketing Practices

To register for our Service, you must agree to our Privacy Policy, Terms of Service, and E-Consent. By registering to use our Service, you are giving your express consent to receive promotional and advertising materials from us, our network of lenders, and third-party marketers with whom we may share your information. They may also provide information to you about additional services and/or products. You further

understand and consent that all communications, whether to assist you in obtaining the loan you requested or for promotional purposes or otherwise, may be through direct mail, e-mail (at the e-mail address you provided) and/or by telephone/mobile device (at the number(s) you provided) regardless of whether your e-mail address and/or numbers may be listed on a corporate, state, or federal Do-Not-Contact registry, suppression list, or the like.


To opt out of receiving such marketing materials and/or communications, you may request to be removed by using the relevant opt-out mechanism in such communications or by contacting the third party directly. We are not responsible for any promotional and advertising materials sent to you by the lender and other marketers and have no control over stopping unwanted communications directed to you from sources beyond our direct control.
